Elasta SafeSip is a supplemental personal-safety product designed to help monitor the status and movement of a compatible Elasta SafeSip drink cover and provide status information through the mobile application. Please read this Safety Disclaimer carefully before using the Elasta SafeSip device or application.
Important Safety Notice
Elasta SafeSip is intended only as an additional safety tool. It does not prevent drink tampering, drink spiking, poisoning, theft, assault, injury, or any other harmful act.
The device and application cannot detect drugs, chemicals, alcohol, contamination, or foreign substances in a beverage. A “Safe” status means only that the device has not detected activity that meets its programmed tamper or movement criteria. It does not confirm that a beverage is safe to consume.
A “Tamper,” warning, or alert status indicates that the device detected movement, disconnection, interference, or another event that met its programmed alert criteria. It does not prove that someone tampered with the beverage.
Technology Limitations
Elasta SafeSip depends on electronic components, Bluetooth connectivity, battery power, device placement, sensor calibration, compatible mobile hardware, software, and user settings. Alerts or status information may be delayed, inaccurate, interrupted, or unavailable because of circumstances including:
- Loss of Bluetooth connection;
- Low or depleted battery power;
- Improper installation or placement;
- Fabric, sensor, or hardware damage;
- App shutdown or background restrictions;
- Disabled Bluetooth, permissions, or notifications;
- Phone power loss or connectivity problems;
- Normal movement that triggers a false alert;
- Tampering or activity that does not trigger the sensor;
- Firmware, software, server, or network interruptions; or
- Use with an unsupported cup, container, straw, phone, or operating system.
The absence of an alert does not guarantee that no tampering or unsafe activity occurred.
User Responsibilities
You are responsible for:
- Installing and using the product according to all provided instructions;
- Confirming that the device is properly connected before relying on monitoring;
- Checking the device battery and connection status;
- Keeping your phone, Bluetooth, and required permissions active;
- Testing the device before each monitoring session;
- Keeping your beverage within your control whenever reasonably possible;
- Inspecting the device for wear, damage, moisture intrusion, or malfunction;
- Cleaning and maintaining the product according to the provided instructions; and
- Discontinuing use if the device appears damaged or does not operate correctly.
Do not rely on Elasta SafeSip as your only personal-safety measure.
What to Do if You Suspect Tampering
If you receive an alert or believe your beverage may have been tampered with:
- Do not consume the beverage;
- Move to a safe location;
- Tell a trusted person, venue employee, security professional, or law-enforcement officer;
- Seek medical attention when appropriate; and
- In an emergency, call 911 or the appropriate local emergency service.
Elasta SafeSip is not an emergency-response service. The application does not contact law enforcement, emergency medical personnel, venue security, friends, or family members unless a separate feature expressly states that it does so.
No Medical or Professional Advice
Elasta SafeSip does not provide medical, toxicological, legal, security, or law-enforcement advice. Information shown by the application should not be used to diagnose, treat, or determine whether a person has consumed a dangerous substance.
Seek immediate professional assistance when you believe you or another person may be in danger.
Proper Use
Do not use the device in a manner that interferes with safe drinking, creates a choking hazard, damages a container, or exposes electronic components to conditions beyond the product’s stated limitations.
Keep small components away from children and pets. Do not use the product if any component is loose, torn, punctured, damaged, or missing. The product is not a toy and is not intended for unsupervised use by children.
Assumption of Risk
You understand that no device or application can eliminate all risks associated with beverages, public environments, social settings, criminal conduct, equipment failure, or human error. To the fullest extent permitted by applicable law, you accept the risks associated with using or relying on the Elasta SafeSip device and application.
Limitation of Responsibility
To the fullest extent permitted by law, QUEST POINT TECHNOLOGIES LLC, ELASTA SAFESIP, and their owners, employees, contractors, developers, manufacturers, suppliers, and service providers are not responsible for harm caused by:
- A user’s reliance on a “Safe” status;
- A missed, delayed, inaccurate, or false alert;
- Bluetooth, battery, phone, server, sensor, or software failure;
- Improper use, installation, cleaning, storage, or maintenance;
- Modification of the device or application;
- Use with incompatible products;
- Failure to follow instructions or respond to a warning; or
- The intentional or unlawful actions of another person.
Nothing in this disclaimer excludes responsibility that cannot legally be excluded under applicable law.
Privacy and Permissions
The application may require Bluetooth access and notification permissions to connect with the Elasta SafeSip device and provide supported alerts or status updates. Account, device, authentication, diagnostic, and usage information may be processed as described in the Elasta SafeSip Privacy Policy.
